Hello my question is if I’m a bather and get paid hourly by check and/or cash is it illegal that my employer gave me a 10-99 tax form? I thought those were for independent contractors but yet I get paid hourly and that employer supplies all the stuff and makes the hours.

We only get a 1099 form for dividends and other income from stocks and natural gas lease income. If you are an hourly employee, you should receive a W-2 form.

1099 MISC is used, among other things, to report payments made to contract workers. Some employers will improperly (re: illegally) do this to avoid paying benefits and/or withholding taxes, Medicare and Social Security, and worker's comp insurance.

1099 workers end up paying the self-employment tax as well as the matching payments that the employer would otherwise be responsible for.

I think my employer is but this person has payroll doing their taxes. So is it to late to request a w2 or should I report to irs? My personal opinion I don’t think the person who does payroll have themself a 1099 but a w2 or gets cash every week.
