I have a problem with the neighbors' dog

I don't like admitting this to myself, let alone anyone else...but I really have a problem with our next-door neighbor's dog.

First, the dog is a Pit. Now, I don't really have problems with Pits or Pit mixes (in fact, I suspect our Jack has some Pit in his mix) but I DO have a problem with people who own them and have the attitude these particular neighbors have.

The dog is probably around 2 years old now. He is not altered and has never been given any kind of training. He spends most of his life locked in the garage, although most days he is let out to run around in their backyard for an hour or two. He is decidedly aggressive towards us, even though we have always spoken kindly to him and occasionally I toss a treat over the fence to him when we are outside with our dogs. The owner (and his family) are apparently proud of having a "mean dog" and were appalled when we had each of our boys neutered and taught them good manners.

My problem is that we live in a city neighborhood...which means long, tall, skinny houses about 10 feet apart with little fenced backyards and garages facing on an alley. The fence between our yard and this neighbor's is about 3" high and I am absolutely terrified their dog is going to jump the fence one day and have at my boys. I never let them out when he is out, but the idiots have no compunction about letting him out when ours are in the yard (I let them out on a 10-minute timer) and there have been a few close calls. Per neighborhood covenants,to put in a higher fence, he has to approve and he won't (we tried to talk him into it last year and he was rather nasty about it).

I know this dog has never been to a vet and has no rabies tags...which are required by law. It IS possible for me to report this dog anonymously, but I am sure they would just take him and dump him somewhere if fined and then get another dog.

What would you do? I don't think the dog is actually a 'bad' dog, but he isn't controlled and I can't stand by and wait for him to attack (and probably kill my little one) to act. BTW, the neighbor on the OTHER side has two dogs that are charming...and SHE'S afraid of this dog's potential for violence, too.

Eeeks not a good situation. I say report him. I understand the poor dog's future will be up in the air and they could possibly get another dog and you would be in the same boat - but I can't imagine worrying about my kids' safety at my own house. This sounds like a dangerous situation. So sad because the one that has lost in all of this is the dog. Why why why do people like this even get dogs in the first place?????

If you are willing to put up the fence, you could always tell him that you are doing the fence and if he complains you will report his dog to animal control...

Is there a city bylaw that says how high a fenced must be to contain a dog?

I would certainly think you could report this anonomously. Call and find out.

Oh my that is i tough situation ya know! Its a shame the neighbor isnt more responsible and is totally clueless! I hope you find a way to straighten this out and I also hope that your babies are safe from their aggressive dog! Good luck

This is deja vue, and not in a good way.

I lived in the same situation, except it was German Shepherd and not a Pit. The dog eventually did get into our yard on a winter's day when the snow was high and the neighbour was walking him in the back alley off leash. He easily got over the fence, jumped on my poor border collie from behind while he was having a poo, and chewed him up badly. He required surgery, a pin in his leg, thousands of dollars in vet bills, and I had to retire him from flyball which was an activity we both loved. The owner refused to pay for anything, because his insurance didn't cover it and it was just "dogs being dogs". I reported it to Animal Control, and they promptly came over and slapped a muzzle order on both our dogs. That in spite of the fact mine was not able to walk, in bandages, had a CGC certificate and FDX, and was clearly gentle. The GS went after the officer when she went into the neighbour's house to question the owner. The officer said she wasn't allowed to exercise any discretion in the matter, and apologized to me. The neighbour ignored the order, of course. It eventually went to a hearing and the muzzle order was lifted off my dog and the German Shepherd went into their records with a permanent muzzle order, which again, the owners ignored. Animal Control took no other action because it was a "dog on dog" attack.

I took the guy to small claims court, sued him and won. He moved away to avoid paying me (yay). I found him and served him papers. I took out a private warrant for his arrest when he still didn't pay. The police caught up with him on a traffic violation, and THEN he paid. It took two years. I don't know if I'd do it again knowing what a long, emotional, expensive process it would be, but justice was served. It wasn't about the money.

The summer after my dog was attacked, a woman was attacked and injured by this dog when she went on to their property by mistake. It could have been a child. It would eventually have been a child, except they finally got rid of the dog. I don't know what happened to it. I'm sorry the dog landed had such horrible owners. But I was very relieved - he was dangerous.

So my advice is this: Take whatever steps you can now to protect yourself and your pets. Put up the fence. Report the dog. If there's dangerous breed legislation in your town, take advantage of it. I'm not saying I agree with it, I don't. But this dog WILL attack, it's a matter of "when", not "if". Use whatever resources you have to prevent it from happening.

Sorry if I'm alarming you - I lived it. It's no fun.

Why would he have any say in whether or not you can put a fence up on your property? I'd put up a 6 to 8 foot chain link or privacy fence and report him.

This is a very sad situation to be in. It's never a good feeling to feel afraid while you are at your own home. I don't really have anything to add, but I feel like gills has some good advice there. Bad owners should have to face the consequences for the dogs that they create.

Since he is being so nasty about a higher fence, and you have a REALLY good reason to put one up, could you just go over his head to the neighborhood association?

Good question, hopefully you have an HOA and they will assist you. If not what about putting up a lattice type fence just inside the existing fence. That way it is in your yard.

There are two things that you can do.

One is to write a petition letter addressed to any authority in your neighborhood. If you have a homeowners' association, send it to the president. Your last resort would be the police.

The other one is for you to build the fence yourself. Of course within your property. Your neighbor can't do anything about that. That way you'll feel safer even if they let their dog out the whole day.

We had a similar situation except the pit was permanently in the backyard with no one ever playing with it and it was mean. However, we had a fence. Even with that fence it made me nervous. If I were in your shoes I would be very upset.

Thanks for your input, everyone. I am waiting to hear back from Animal Control on whether this dog constitutes "a dangerous dog" via municipal statutes. Probably not, as he hasn't bitten anyone yet...that we know of. Also have a call in to the HOA about the fence. I'll let you know what happens.
