He is still very young, and Toy breeds need to be let out to potty more frequently than larger breeds. He's also adjusting to his new home, and to you. Put him on a schedule for eating and eliminating, and jot down the times he goes, so you have a better idea how much time it takes between eating and eliminating. He may have been kept crated for long periods of time if he came into shelter from a breeder.

This is very normal; everything in his life has changed, and he'll need time to feel safe and secure. Do everything you can to boost his confidence.

I try to keep him occupied in his crate with toys and a dried pig ear for bone which he loves to chew on but 90 percent of the time is just spinning and he wont stop, when he does he will yap.

How much time is he spending in the crate? The spinning may be stress related.

Also I can't tell if he understands the word no or a lower voice. I will say NO but he will keep on doing what hes doing. I know hes not deaf because he comes when I call him. please help me figure this out. thanks

Telling a dog no means absolutely nothing to him. Instead of saying no, distract him, and then redirect him to something else. Rather than thinking in terms of what you don't want him to do, teach him what you do want him to do instead.
